Try Sailing Risk Warning

All visitors wishing to try sailing and participate in any sailing event organised by Botany Bay Yacht Club must have read and acknowledged this Sailing Risk Warning.
  • Welcome to Botany Bay Yacht Club!

    Before participating in any BBYC sailing event you must read and accept the following Try Sailing Risk Warning.

    If you are not yet a member, in reading and understanding this form you agree to apply for BBYC membership after sailing with the Club no more than three times. Please note that all new membership applications are subject to endorsement by the Board and receipt of the new membership payment.

  • This RISK WARNING is issued jointly by the Botany Bay Yacht Club (BBYC) and NSW Roads and Maritime Services (RMS), pursuant to the Civil Liability Act 2002, to all persons wishing to participate in sailing activities conducted by the Botany Bay Yacht Club.

    Participants are warned that, regardless of the precautions, which might be taken by reasonable and experienced persons, sailing can be a dangerous pursuit and participants are exposed to significant risk of property damage, physical harm and possible injury or death. As an indication, these risks include, but are not limited to:

    - The extremes of weather and sea conditions;
    - The potential that control of vessels may be lost, resulting in collision with objects and other vessels;
    - The sudden movement of the vessel at any time and the possibility that participants may fall or be thrown overboard, resulting in injury or drowning;
    - The possibility that participants may be injured by equipment on the vessel;
    - The absence of immediate medical care and the likelihood that significant delay may occur before medical care is available;
    - Exposure to the elements for extended periods

    BBYC and RMS warn participants that, regardless of their best intentions, they may be unable to render assistance to participants who are in distress.

    Participants are warned to consider the above risks and all other risks before deciding to participate in any BBYC sailing event.

    Participants are also advised that although BBYC is covered by third party liability insurance, this cover does not extend to participants. However, it is mandatory that all boats registered with BBYC are required to carry appropriate and adequate insurance.

    Any participant who considers they have a need for personal insurance shall make their own private arrangements with an insurer.

  • SKIPPER RESPONSIBILITY

    Please note that individual skippers are responsible to ensure each crew member has read, understood and accepted the RISK WARNING before participating in a BBYC event on their boat.

    Skippers are responsible to ensure any non-member who has participated in three BBYC events is required to apply for BBYC membership prior to any further participation in a BBYC sailing event. To enable this, individual skippers shall maintain a personal record of event participation for the non-member detailed above.

    This RISK WARNING form shall be stored by BBYC and made available to skippers as required.

    Skippers shall advise a BBYC Flag Officer (or Director in the absence of a Flag Officer) when a non-member has participated in three BBYC sailing events.
